Marchon3D to Add Key Patents to Portfolio

Company Continues To Build Strong Patent Portfolio with the Announcement of Two Additional Notices of Allowance for M3D 3D Lenses

LAS VEGAS, April 12, 2011 — (NAB BOOTH #SL9123) — Marchon3D™ today announced two more additions to its expanding patent portfolio of revolutionary circular, polarized 3D eyewear.

Marchon3D, the premier designer and supplier of the most technologically-advanced, fashion-forward 3D eyewear on the market, received a Notice of Allowance from the U.S. Patent and Trademark Office for U.S. Patent Application No. 12/495,754 on April 4, 2011. That was quickly followed by a subsequent Notice of Allowance issued on April 6, 2011 for U.S. Patent Application No. 12/350,092. Both of these applications protect the innovative curved lenses that are configured to decode passive three dimensional content. Marchon3D expects that patents will be issued for these inventions within the coming weeks.

Marchon3D is pursuing a comprehensive patent portfolio for its 3D eyewear. The patent issued earlier this year to Marchon3D, U.S. patent 7,854,506, is currently under reexamination, due to additional prior art filed with a request for reexamination. Following the filing of this request for reexamination, Marchon3D immediately requested that the Patent Office consider whether the additional prior art cited in the reexamination affected the patentability of Marchon3D’s unique inventions described in the two patent applications (which were both recently issued a Notice of Allowance in February 2011). The Patent Office took less than 28 days to conclude that patents should still be granted on these inventions. In light of the quick turn around of these two Notices, Marchon3D is confident the reexamination will be dealt with in an equally efficient manner.

“What this really means is that Marchon3D has further strengthened the initial patent that was issued earlier this year, protecting our revolutionary 3D lenses,” said David Johnson, President of Marchon3D. “We have patent applications under review in the United States and other parts of the world. The patent portfolio will prevent the sale of infringing products within the United States, as well as the importation of infringing circular polarized 3D lenses into the country. We are committed to the protection of the portfolio and are ready to pursue aggressive and immediate action to defend our IP rights.”

Marchon3D’s U.S. Patent Application No. 12/350,092 protects the 3D lenses as well as the manufacturing of the lenses. This application is addressed to thermoformed curved lenses comprising a polarizing layer laminated with one or more polymeric material layers and a retarder layer in which the retarder layer is aligned to decode a desired circular polarization. U.S. Patent Application 12/495,754 relates to a similar invention but uses a press polishing process to form a curved 3D lens.
