BD4C Rolls Out Blu-ray Patent Incentive for China

BD4C Announces a Limited-Time Incentive Program for Blu-ray Disc Products Manufactured and Sold for Use Within the People’s Republic of China

November 22, 2011 — Tokyo, Japan – The BD4C Licensing Group – consisting of leading technology companies, Columbia University, Disney, Mitsubishi Electric Corporation, Technicolor, Toshiba Corporation and Warner Bros. Home Entertainment – today announced that it is launching a new, limited-time incentive plan available to all companies that wish to obtain portfolio licenses to the BD4C members’ essential patents for Blu-ray Disc (“BD”) products (including BD products that incorporate DVD functionality) manufactured and sold for use exclusively within the People’s Republic of China.

Under this incentive plan, companies that enter into a license agreement with the BD4C Licensing Group by November 30, 2011 will benefit from a 100% discount on royalties accruing for BD products manufactured and sold prior to November 30, 2011 for use exclusively within the People’s Republic of China.

In addition, licensees who have no overdue or incorrect royalty reports or overdue or underpaid royalties (including back royalties) and are otherwise in compliance with their Patent License Agreement with the BD4C Patent Licensing Group will also benefit from a 100% discount on royalties for BD products manufactured for use exclusively within the People’s Republic of China and sold exclusively within the People’s Republic of China from December 1, 2011 to June 30, 2012 for use exclusively within the People’s Republic of China.

All BD4C licensees, including current and future licensees, are eligible to enjoy the benefits of this incentive plan, provided that they meet the requirements described above. Licensees that have already paid royalties will be entitled to receive a credit against future royalties in the amount of the applicable discount on royalties accruing for BD products manufactured and sold for use exclusively within the People’s Republic of China.

For BD products other than those manufactured and sold for use exclusively within the People’s Republic of China, all royalties, including back royalties, remain payable according to existing royalty rates.
