Toshiba Corporation, the authorized licensor for DVD6C, terminates DVD6C Patent License Agreement with Premium Disc Corp. following arbitral award and court judgment for nonpayment of royalties.
February 20, 2013 — The DVD6C Licensing Group (“DVD6C”) — consisting of nine leading developers of DVD technology—today announced that its authorized licensor, Toshiba Corporation, terminated its Patent License Agreement with Premium Disc Corp. of Ontario, Canada, effective as of December 5, 2012, for nonpayment of royalties. The termination follows an arbitration in which the Arbitral Tribunal found that Premium Disc had breached the DVD6C Patent License Agreement and awarded Toshiba royalties, interest and legal fees/costs. The Ontario Superior Court of Justice recognized and enforced that award and ordered Premium Disc to pay all amounts due, along with interest and costs. These proceedings are part of a continuing global initiative by DVD6C to enforce the DVD6C Patent License Agreement.
